Creator Music & Rights Policy
This policy applies when a creator submits a single or album to the Ohole music catalog, lets users add an Ohole catalog track to social video, or opts a release into Ohole Radio. It supplements the Terms and Privacy Notice.
Ohole is not a music label, commercial DSP distributor, publisher, record company, collecting society, or rights-clearance service. Uploading a recording to Ohole does not distribute it to Spotify, Apple Music, radio broadcasters, or other services; does not make Ohole a NASCAM licensee for the submitted work; and does not guarantee royalties, chart payments, or collection by NASCAM or another society.
Rights you need before upload
You must have written authority for every right and territory you select. A song may contain separate rights in the musical composition and lyrics, the sound recording/master, the performances, samples or interpolations, beats and production, and the cover artwork. You are responsible for obtaining permissions from co-writers, publishers, labels, performers, producers, beat makers, sample owners, and any other rights holder. Owning the recording file, paying for a beat, or having a creator account does not by itself establish all those rights.
- Creator-owned: use this only if you control the rights needed for the recording and the underlying work, including contributor and performer permissions.
- Public domain: a public-domain composition does not automatically make a modern recording, arrangement, performance, or artwork public domain. Confirm each right separately.
- Licensed: keep the signed license, contract, permission, or other evidence. It must cover Ohole hosting and on-demand playback, any social-video synchronization you enable, Ohole Radio if selected, and the countries and dates you specify.
Territories and uses
Choose only the countries where your permissions are valid. “Worldwide” is an assertion that you hold the required rights everywhere Ohole makes the release available; it is not a broader license from Ohole or a rights organization. Your attestation allows Ohole to host and make the release available in the selected territories through the Ohole catalog. Social-video use and Radio are separate optional permissions and are limited to the uses and countries selected in the upload form. The social-video soundtrack uses clips of up to 60 seconds. Ohole music uploads may include complete tracks up to seven minutes; upload limits do not determine the duration or scope of any third-party license.
NASCAM and collective management
NASCAM describes itself as Namibia’s collective management organization for authors, composers, lyricists, and music publishers. Its membership information says creators sign a deed of assignment authorizing administration of specified rights, and its current membership guidance describes performance-rights administration. A membership or work registration can therefore affect what a creator may license directly. Check the exact deed, repertoire registration, co-writer or publisher arrangements, and the license scope with NASCAM before granting Ohole overlapping rights.
NASCAM’s published music-user guidance describes licenses for public, recorded, broadcast, and live music, and its site lists a jukebox license. That does not by itself establish whether an Ohole on-demand catalog, ad-supported jukebox, radio stream, user-generated social video, or a particular territory is covered. The Ohole operator must obtain written guidance from NASCAM and any other relevant rights holders for each use; users watching an ad or creators ticking a rights box does not license Ohole to use repertoire managed by NASCAM.
A NASCAM license or membership should not be assumed to clear a sound recording/master, neighboring rights, performers, samples, a label’s interests, or rights outside the mandate and territory. Ohole has not represented that it holds a blanket NASCAM, publisher, label, neighboring-rights, or worldwide license for every creator submission. Before enabling a territory or use, creators and the operator should confirm the applicable rights directly with NASCAM and each relevant rights holder or qualified counsel.
Permission granted to Ohole
When you submit and activate a release, you grant On-delo permission, for the selected territories and selected uses, to store, reproduce as technically necessary, stream, display the cover artwork, make the enabled short social-video clips available, and include the release in Ohole Radio if you opted in. This permission lasts while the release is available and ends when it is withdrawn or disabled, except for limited copies or records retained for safety, security, legal, or transaction purposes. You keep ownership of your rights. This does not authorize Ohole or users to use the song outside the Ohole features and territories described here.
Claims, takedowns and records
Do not submit music that infringes another person’s rights or that you cannot authorize. Keep records establishing ownership, permissions, contributor consent, territory, term, and any NASCAM or publisher arrangements. Send a rights complaint or takedown request to [email protected] with the release link, the right claimed, your contact details, and a good-faith explanation. Do not include private identity documents or confidential contracts unless support requests them through a secure channel. Ohole may restrict, mute, withdraw, or remove a release while a rights issue is assessed and may restrict accounts that repeatedly upload unauthorized content. A mistaken or abusive claim may also have legal consequences.
